Peppercorn Hill - Terms and conditions of the DFC Up to $15K Land Rebate Promotion

  1. ​The promoter is DFC (Woodstock) Pty Ltd ABN 83 161 448 139 of Level 1, 863 High Street Armadale, Victoria 3143 (Promoter).
  2. This promotion (Land Rebate Promotion) entitles the Buyer of a Selected Lot to a Rebate, upon Settlement of that Selected Lot, provided that the Buyer satisfies the Rebate Eligibility Criteria.
  3. For the avoidance of doubt, this Land Rebate Promotion is only available to Buyers of Selected Lots who meet the Rebate Eligibility Criteria outlined in clause 6 below.
  4. In addition to the Land Rebate Promotion, the Buyer may be eligible for a separate promotion by the Promoter known as the Deposit Guarantee Promotion, where the deposit paid under the DFC Contract could be applied to the deposit that is due under a future purchase contract for Selected Lots within the same DFC Community that the Buyer originally purchased in. The Deposit Guarantee Promotion is subject to separate terms and conditions and eligibility criteria which can be found at https://peppercornhill.com.au/upto-campaign-terms.
  5. This Land Rebate Promotion will run for the Land Rebate Promotion Period, which may be reduced by the Promoter in its absolute discretion. For the avoidance of doubt, the Land Rebate Promotion does not apply to any DFC Contracts entered into or Lots reserved (with or without a holding deposit) outside of the Land Rebate Promotion Period.
  6. To be eligible to receive a Rebate under the Land Rebate Promotion, the Buyer must meet the following requirements (Rebate Eligibility Criteria):
    • sign and deliver the DFC Contract for a Selected Lot within the Land Rebate Promotion Period via any one of the following methods
      • hand delivery;
      • mail;
      • facsimile;
      • email; or
      • e-contract portal; and
    • pay the Deposit within 7 days of entry into the DFC Contract;
    • provide the Promoter with evidence (to the Promoters satisfaction, in its discretion) that the Buyer holds finance pre-approval at the time the DFC Contract is signed;
    • effect Settlement no later than: 
      • in respect of titled Lots, the earlier of the date that is 80 days from the date on which the DFC Contract is signed and any date separately agreed by the Promoter; or
      • in respect of untitled Lots, 14 days after the Buyer receives notification that the plan of subdivision for the Selected Lot has been registered; and
    • with the exception of the Deposit Guarantee Promotion, not have participated in any other incentive programs offered by the Promoter or its Related Entities in connection with the Lot that is the subject of the DFC Contract signed by the Buyer;
    • strictly comply with these terms and conditions and the DFC Contract.
  7. If the Buyer meets the Rebate Eligibility Criteria, the balance of the applicable purchase price payable by the Buyer due to the Vendor at Settlement (being the applicable purchase price less the Deposit already paid) will be reduced by the amount of the Rebate. For the avoidance of doubt, the Buyer will not be entitled to receive the Rebate in cash or in any other form - such amount will only be applied as a Rebate to the purchase price payable to the Vendor.
  8. By participating in this Land Rebate Promotion, the Buyer acknowledges and agrees that:
    • the Promoter, Dennis Family Corporation Pty Ltd ABN 15 089 081 667 and its Related Entities (together, the Dennis Group) may collect the Buyer's Personal Information directly from the Buyer or via third parties (such as estate agents, sales agents and referrers);
    • the Dennis Group will use the Buyer's Personal Information to conduct and administer the Land Rebate Promotion (including by considering the Buyer's expression of interest in the Land Rebate Promotion, validating whether the Buyer has met the Rebate Eligibility Criteria, processing the Rebate if the Buyer has met the Rebate Eligibility Criteria);
    • the Buyer's Personal Information may be shared:
      • with the Vendor;
      • within the Dennis Group; and
      • with third parties outside of the Dennis Group (such as government agencies, banks, professional advisors, contractors, real estate agents and any other service providers), for the purposes of this Land Rebate Promotion or for related or similar purposes;
    • if the Buyer chooses not to provide any Personal Information that the Dennis Group requests in connection with this Land Rebate Promotion (whether directly or through its agents), then the Buyer may not be able to participate in the Land Rebate Promotion and/or the Dennis Group may not be able to process the Rebate; 
    • subject to anything otherwise set out in the DFC Privacy Policy the Dennis Group does not disclose Personal Information outside Australia;
    • the Buyer's Personal Information will be handled by the Dennis Group in accordance with the DFC Privacy Policy which is available upon request or can be viewed at https://www.denniscorp.com.au/wp-content/uploads/2019/09/Privacy-Statement_2019.pdf;
    • the DFC Privacy Policy states how the Buyer can seek to access or correct any Personal Information the Dennis Group holds about the Buyer, how to raise a privacy complaint and how the Dennis Group will deal with a privacy complaint if received; and
    • the Buyer can contact the DFC Privacy Policy Officer by email at privacy@denniscorp.com.au or by calling 03 9573 1208.
  9. By participating in this Land Rebate Promotion, the Buyer consents to receiving communications, including marketing and promotional materials, via electronic means from the Dennis Group.
  10. The Buyer acknowledges and agrees that the Promoter has not at any time made any warranties or representations about the suitability or impact of this Land Rebate Promotion on the Buyer's circumstances. The Buyer promises the Promoter that it has made all necessary enquiries and sought independent advice on the terms and conditions of this Land Rebate Promotion before participating.
  11. To the extent permitted by law, the Buyer releases and indemnifies the Promoter and each other member of the Dennis Group and each of their officers, employees, representatives, agents and contractors from all losses, claims or damages suffered, incurred or resulting from or in connection with their participation in this Land Rebate Promotion.
  12. The Promoter holds the benefit of clause 11 on trust for each member of the Dennis Group and each of their officers, employees, representatives, agents and contractors.
  13. The following definitions apply in these terms and conditions:
    • Buyer(s) means any person who purchases a Selected Lot during the Land Rebate Promotion Period (for the avoidance of doubt, a Buyer does not include a nominee, and nominees will not be accepted for this Land Rebate Promotion).
    • Deposit means the deposit amount referred to in the DFC Contract.
    • DFC Community means the residential development of the Promoter or its Related Entities that is marketed under the name Peppercorn Hill.
    • DFC Contract means the contract for the sale of a Lot in the DFC Community between the Buyer as the purchaser, the Promoter as the developer and the Vendor.
    • Land Rebate Promotion has the meaning provided in clause 2 of these terms and conditions. 
    • Land Rebate Promotion Period means 20 July 2020 to 5.00pm on 13 September 2020, unless varied in accordance with these terms and conditions.
    • Lot means a lot on a plan of subdivision for a DFC Community and includes 'Lots'.
    • Personal Information has the meaning given to that term in the Privacy Act 1988 (Cth).
    • Rebate means a rebate offered to the Buyer under this Land Rebate Promotion and in accordance with the Agreement and the DFC Contract. The amount of the Rebate offered will be determined with the Buyer under the DFC Contract and with reference to the specific Lot purchased.
    • Rebate Eligibility Criteria means the requirements set out clause 6 of these terms and conditions which a Buyer must satisfy to be eligible to receive the Rebate.
    • Related Entity or Related Entities has the same meaning given to it under the Corporations Act 2001 (Cth).
    • Selected Lots mean the Lots (both titled and untitled) selected by the Promoter, the particulars of which can be provided upon request.
    • Settlement means the provision of vacant possession of the Lot to the Buyer, and the acceptance of title and payment by the Buyer of the purchase price and all other money due to the Vendor under the DFC Contract.
    • Vendor means the party who is listed as the vendor in the DFC Contract. 

 

Deposit Guarantee promotion terms and conditions

  1. The promoter is DFC (Woodstock) Pty Ltd ABN 83 161 448 139 of Level 1, 863, High Street, Armadale, Victoria 3143 (Promoter).
  2. This promotion (Deposit Guarantee Promotion) entitles the Buyer of a Selected Lot to apply the deposit paid under a Promotion Contract to the deposit that is due under a Future Purchase Contract, if the Buyer meets the Deposit Guarantee Eligibility Criteria.
  3. For the avoidance of doubt, this Deposit Guarantee Promotion is only available to Buyers of Selected Lots who meet the Deposit Guarantee Eligibility Criteria outlined in clause 18 below.
  4. This Deposit Guarantee Promotion will run for the Deposit Guarantee Promotion Period which may be reduced by the Promoter at its absolute discretion. For the avoidance of doubt, the Deposit Guarantee Promotion does not apply to any DFC Contracts entered into or Lots reserved (with or without a holding deposit) outside the Deposit Guarantee Promotion Period.
  5. To be eligible for the Deposit Guarantee, the Buyer must meet the following requirements (Deposit Guarantee Eligibility Criteria):
    • sign and deliver a DFC Contract for a Selected Lot within the Deposit Guarantee Promotion Period via any one of the following methods:
      • hand delivery;
      • mail;
      • facsimile;
      • email; or
      • e-contract portal; and
    • pay the Deposit within 7 days of entry into the Promotion Contract;
    • have had his or her employment terminated after the Promotion Contract has been signed, and on or before the settlement due date under the Promotion Contract;
    • provide the Promoter with evidence (in a form reasonably satisfactory to the Promoter) that the Buyer's employment has been terminated as outlined in clause 18(c) above, and such evidence must be provided to the Promoter on or before the settlement due date under the Promotion Contract (or such other later date agreed to in writing by the Promoter);
    • sign and deliver a deed of cancellation of the Promotion Contract to the Promoter in the form provided by the Promoter;
    • sign and deliver the Future Purchase Contract within the Future Purchase Period via any of the methods listed in clause 18(a); 
    • with the exception of the Land Rebate Promotion, have not participated in any other incentive programs offered by the Promoter or its Related Entities in connection with the Lot that is the subject of the DFC Contract signed by the Purchaser; and
    • otherwise strictly comply with these terms and conditions and the Promotion Contract.
  6. If the Buyer meets the Deposit Guarantee Eligibility Criteria, the Deposit Paid will be applied to pay the Future Deposit on the fourth business day after the Buyer signs the Future Purchase Contract. Where the Deposit Paid exceeds the Future Deposit, the surplus amount (being the difference between the Deposit Paid and Future Deposit) will be applied at settlement to reduce the amount payable by the Buyer under the Future Purchase Contract.
  7. For the avoidance of doubt, as the Deposit Guarantee Promotion provides the Buyer with the ability to apply the Deposit Paid to the Future Deposit, the Buyer will not be eligible for this promotion if:
    • the Buyer does not meet the Eligibility Criteria; or
    • the Promotion Contract has been ended by means other than the deed of cancellation set out in clause 18(e) above.
  8. There may be circumstances where the Deposit Guarantee is not available or the Deposit Paid is forfeited beyond the scope of the Deposit Guarantee Promotion. The Promotion Contract will set out such terms in detail, and a copy of the Promotion Contract can be provided to the Buyer upon request.
  9. By participating in this Deposit Guarantee Promotion, the Buyer acknowledges and agrees that:
    • the Promoter, Dennis Family Corporation Pty Ltd ABN 15 089 081 667 and its Related Entities (together, the Dennis Group) may collect the Buyer's Personal Information directly from the Buyer or via third parties (such as estate agents, sales agents and referrers);

    • the Buyer's Personal Information may be shared:
      • with the Vendor;
      • within the Dennis Group; and
      • with third parties outside the Dennis Group (such as government agencies, banks, professional advisors, contractors, real estate agents and any other service providers), for the purposes of this Deposit Guarantee Promotion or for related or similar purposes;
    • if the Buyer chooses not to provide any Personal Information that the Dennis Group requests in connection with this Deposit Guarantee Promotion (whether directly or through its agents), then the Buyer may not be able to participate in the Deposit Guarantee Promotion and/or the Dennis Group may not be able to apply the Deposit Guarantee;
    • subject to anything otherwise set out in the DFC Privacy Policy, the Dennis Group does not disclose Personal Information outside Australia;
    • the Buyer's Personal Information will be handled by the Dennis Group in accordance with the DFC Privacy Policy which is available upon request or can be viewed at https://www.dennisfamily.com.au/privacy-policy/;
    • the DFC Privacy Policy states how the Buyer can seek to access or correct any Personal Information the Dennis Group holds about the Buyer, how to raise a privacy complaint and how the Dennis Group will deal with a privacy complaint if received; and
    • the Buyer can contact the DFC Privacy Policy Officer by email at privacy@denniscorp.com.au or by calling 03 9573 1208.

  14. The following definitions apply in these terms and conditions:
    • Buyer(s) means any person who purchases a Selected Lot during the Deposit Guarantee Promotion Period but it does not include an Excluded Buyer (for the avoidance of doubt, an Excluded Buyer will not be accepted for this Deposit Guarantee Promotion).
    • Deposit means the deposit amount referred to in the Promotion Contract.
    • Deposit Guarantee means the arrangement set out in clause 19 of these terms and conditions.
    • Deposit Guarantee Promotion has the meaning provided in clause 15 of these terms and conditions.
    • Deposit Guarantee Promotion Eligibility Criteria means the requirements set out in clause 18 of these terms and conditions which a Buyer must satisfy to be eligible to receive the Deposit Guarantee.
    • Deposit Guarantee Promotion Period means 20 July 2020 to 5pm on 13 September 2020, unless varied in accordance with these terms and conditions.
    • Deposit Paid means the deposit paid under the Promotion Contract.
    • DFC Community means the residential development of the Promoter or its Related Entities that is marketed under the name Peppercorn Hill.
    • DFC Contract means the contract for the sale of a Selected Lot in the DFC Community between the Buyer as the purchaser, the Promoter and the Vendor.
    • Excluded Buyer means a buyer that is a corporation, a registered builder or a nominee of the Buyer.
    • Future Deposit means the deposit payable under the first Future Purchase Contract signed by the Buyer during the Future Purchase Period.
    • Future Purchase Contract means the DFC Contract signed by the Buyer (which must be a unconditional contract but it may be conditional on the plan of subdivision registering by the sunset date set out in the contract), for a Selected Lot that is in the same DFC Community as the Selected Lot purchased under the Promotion Contract, after the cancellation of the Promotion Contract.
    • Future Purchase Period means a period of 12 months (or a longer period agreed to in writing by the Promoter) commencing from the cancellation of the Promotion Contract.
    • Land Rebate Promotion means the promotion that entitles the Buyer of Selected Lots to a rebate upon the settlement of that Selected Lot in accordance with the provisions of the DFC Contract, provided the Buyer satisfies the rebate eligibility criteria. The Land Rebate Promotion is subject to separate terms and conditions and eligibility criteria which can be found at https://peppercornhill.com.au/upto-campaign-terms.
    • Lot means a lot on a plan of subdivision for a DFC Community, and includes 'Lots'.
    • Personal Information has the meaning given to that term in the Privacy Act 1988 (Cth).
    • Promotion Contract means the DFC Contract in respect of a Selected Lot that is signed by the Buyer during the Deposit Guarantee Promotion Period.
    • Related Entity or Related Entities has the same meaning given to it under the Corporations Act 2001 (Cth).
    • Selected Lots mean the Lots (both titled and untitled) selected by the Promoter, the particulars of which can be provided upon request.
    • Vendor means the party who is listed as the vendor in the DFC Contract.
